1. About Privacy Decoded
Privacy Decoded is a website operated from Australia that provides plain-English summaries, grades, and commentary on third-party privacy policies. By using this site you agree to these terms. If you don't agree, please don't use it.
These terms apply to all visitors, registered users, and anyone who submits content or uses the live analyser.
2. Not legal advice
Everything on Privacy Decoded — including analysis pages, grades, red flags, green flags, comparisons, blog posts, and AI-generated output from the live analyser — is provided for general informational purposes only.
None of it constitutes legal advice, legal opinion, or a legal determination of any kind. Privacy Decoded is not a law firm, does not employ lawyers in an advisory capacity, and does not form a lawyer-client relationship with you.
If you need to assess your organisation's privacy compliance, determine whether a policy meets regulatory requirements (GDPR, CCPA, the Australian Privacy Act, or otherwise), or take any action based on a policy's contents, you should consult a qualified privacy lawyer.
3. Grades and analyses are editorial opinions
The privacy grades (A–F) and scores (0–100) we assign to companies are editorial opinions, not objective measurements or legal findings. They reflect our assessment of a policy's language, scope, and user-friendliness at a point in time, based on our published methodology.
Reasonable people can disagree with our grades. Policies change. Our analyses may not reflect the most recent version of a policy. We do not guarantee that every clause of a policy has been captured or that our interpretation is legally correct.
A high grade does not mean a company is legally compliant. A low grade does not mean a company is breaking the law. These are not legal conclusions.
4. AI-generated output
The live analyser uses an AI model (Anthropic Claude) to summarise and grade policy text that you paste in. AI output can be incomplete, inaccurate, or misleading. We do not review or verify AI-generated results before they are shown to you.
Do not treat AI-generated grades, summaries, or red flags as definitive or comprehensive. They are a starting point for your own research, not a substitute for reading the policy yourself or getting professional advice.
5. Acceptable use
By using Privacy Decoded you agree not to:
- ✗Submit confidential, proprietary, or commercially sensitive documents through the live analyser that you are not authorised to share with third-party AI services
- ✗Submit content that contains personal data belonging to other individuals (names, email addresses, health records, financial details, etc.)
- ✗Attempt to circumvent usage limits (e.g. creating multiple accounts to bypass the monthly analyser cap)
- ✗Use automated tools or scripts to scrape, index, or bulk-download content from the site
- ✗Use the service to generate content for spam, misinformation, or to misrepresent the privacy practices of any company
- ✗Interfere with or attempt to compromise the security of the site or its infrastructure
- ✗Reverse engineer, resell, or repackage the service or its output as your own product without permission
6. Accounts and usage limits
Free accounts may run a limited number of live analyses per calendar month (currently 3). This limit exists to manage costs and ensure fair access. We reserve the right to change it with reasonable notice.
You are responsible for keeping your account credentials secure. You must not share your account with others or use another person's account.
We reserve the right to suspend or terminate accounts that violate these terms, abuse the service, or engage in behaviour that harms other users or the site. We will make reasonable efforts to notify you before doing so unless the violation is severe (e.g. a security incident).
7. Third-party privacy policies
We analyse privacy policies published by third-party companies. We do not own, control, or have any affiliation with those companies. Their policies may change at any time and our analyses may become out of date.
We are not responsible for the accuracy, completeness, or legality of the privacy policies we analyse, nor for the practices of the companies we write about.
8. Limitation of liability
To the maximum extent permitted by applicable law, Privacy Decoded and its operators are not liable for any direct, indirect, incidental, or consequential loss or damage arising from your use of this site or reliance on its content — including, without limitation, decisions made based on our grades, analyses, or AI output.
If you are a consumer in Australia, you may have rights under the Australian Consumer Law that cannot be excluded. Nothing in these terms limits those rights.
9. Our content
Our original written analyses, grades, methodology, and site design are our intellectual property. You may link to them, quote short excerpts with attribution, or share them for personal, non-commercial purposes. You may not republish them in full or use them commercially without permission.
Privacy policies themselves are published by third parties — we don't claim ownership over them or the text that appears in our evidence quotes.
10. Changes to these terms
We may update these terms from time to time. If we make material changes, we'll post a notice on the site and, where possible, email registered users before the changes take effect. Continued use of the site after changes are posted means you accept the updated terms.
11. Governing law
These terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales, unless you are a consumer with statutory rights to bring a claim in your own jurisdiction.
